Terms of Use

Welcome to Morning Rhythm, provided by HeyJune LLC ("Company," "we," "us," or "our"), a limited liability company. Morning Rhythm ("App," "Service") is a mobile-first homeschool planning tool designed to help families organize their school days, track lessons, and maintain educational records.

By accessing or using Morning Rhythm, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

1. Who May Use Morning Rhythm

You must be at least 18 years old to create an account. Morning Rhythm is designed for use by parents, guardians, and adult educators. The App provides tools for organizing children's education, but all accounts must be held and managed by an adult. We do not knowingly collect personal information directly from children under the age of 13. See Section 9 of the Privacy Policy for our COPPA commitments.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at hello@yourmorningrhythm.com. We reserve the right to terminate accounts that violate these Terms.

3. Subscription Plans & Billing

Morning Rhythm offers the following subscription tiers:

Standard: $12.99/month or $99.00/year. Unlimited children, cloud sync, PDF exports, ISBN scanning, portfolio uploads, records, transcripts, and all planning features.
Founding Families: $5.00/month, locked for the duration of continuous, uninterrupted use. Available to the first 100 subscribing families only. See Section 4 for full terms.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis. All payments are processed by Stripe. You agree to Stripe's terms of service in connection with your subscription.

We may change subscription prices with at least 30 days' notice to you. Price changes take effect at your next renewal date.

4. Founding Families Rate

      The Founding Families rate of $5.00/month is available to the first 100 subscribing families only. This rate is locked for as long as the subscription remains active and uninterrupted. If a Founding Families subscriber cancels their subscription for any reason and later resubscribes, they will be charged the then-current standard rate and will not be eligible to reinstate the Founding Families rate. Continued use is required to keep this rate. The Founding Families rate applies to monthly billing only and is not available on annual plans.
    

5. Refund Policy

Morning Rhythm offers a 14-day free trial for new subscribers. No credit card is required to begin your trial. Your subscription and billing begin automatically at the end of the 14-day trial period unless you cancel before the trial ends. We offer a 14-day refund from the date of your first paid charge. To request a refund, email hello@yourmorningrhythm.com within 14 days of your charge with your account email and reason for the request. After 14 days, all charges are non-refundable. Refunds will not be provided for unused periods of a subscription term following cancellation.

6. Cancellation

You may cancel your subscription at any time through your account settings or by emailing hello@yourmorningrhythm.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features through the end of your paid term. We recommend downloading your Annual Report from Settings → Export Annual Report before cancelling to keep a copy of your records.

7. Your Content

You retain full ownership of all content you enter into Morning Rhythm, including lesson plans, journal entries, notes, and uploaded portfolio photos ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not sell, share, or use Your Content for any other purpose.

Your data remains accessible as long as your account exists. You can download a complete PDF of your school records at any time from Settings → Export Annual Report. We recommend downloading your report before cancelling your subscription. Upon account deletion, all data associated with your account will be permanently deleted.

8. What Morning Rhythm Is Not

Morning Rhythm is a planning and record-keeping tool. It is not an accredited school, a legal compliance service, or a guarantee of meeting any state or local homeschool requirements. Homeschool laws vary by state. You are solely responsible for understanding and complying with the homeschool laws and regulations in your jurisdiction. Morning Rhythm does not provide legal, educational, or regulatory advice.

9. No Reverse Engineering

You may not copy, modify, reverse engineer, decompile, disassemble, or otherwise tamper with any portion of the Morning Rhythm application, code, or infrastructure. All software and content in the App is the property of HeyJune LLC or its licensors.

10. Disclaimer of Warranties

Morning Rhythm is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, HeyJune LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $50.00.

12. Indemnification

You agree to defend, indemnify, and hold harmless HeyJune LLC, its officers, members, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Dispute Resolution & Arbitration

Any dispute arising from or relating to these Terms or your use of Morning Rhythm shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted on an individual basis — you may not bring class action claims. The arbitration shall be conducted remotely. Each party bears its own costs unless the arbitrator determines otherwise.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters related to intellectual property infringement.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which HeyJune LLC is domiciled, without regard to conflict of laws provisions.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the App at least 14 days before changes take effect. Continued use after changes take effect constitutes acceptance.

Privacy Policy

This Privacy Policy describes how HeyJune LLC ("we," "us," "our") collects, uses, and protects information when you use Morning Rhythm. We take your privacy and the privacy of your family seriously.

1. What We Collect

We collect the following information when you use Morning Rhythm:

Account information: Your email address and encrypted password.
App data: The information you enter into the App — children's names, grades, subjects, curriculum details, lesson progress, journal entries, book logs, and schedule preferences.
Portfolio files: Images and PDF files you upload to the portfolio feature, stored in Supabase cloud storage.
Usage data: Basic analytics about how you use the App (e.g., which screens you visit) for the purpose of improving the product. We do not use third-party advertising trackers.
Payment information: We do not store your credit card or payment details. All payment processing is handled by Stripe, which maintains its own privacy policy.

2. What We Do Not Collect

We do not sell your data to anyone, ever.
We do not display ads in the App or allow advertisers to access your data.
We do not collect Social Security numbers, government IDs, or sensitive health information.
We do not collect biometric data.
We do not share your email list or contact information with third parties for marketing purposes.

3. How We Use Your Information

To provide, maintain, and improve the Morning Rhythm service.
To sync your data across devices via Supabase cloud storage.
To send transactional emails (e.g., account confirmation, password reset) via Resend/Supabase.
To send product updates and marketing emails if you have subscribed to our list via Flodesk. You may unsubscribe at any time.
To process payments via Stripe.

4. Third-Party Services

Morning Rhythm uses the following third-party services to operate:

Supabase — Cloud database and authentication. Your app data and account credentials are stored securely in Supabase with row-level security (RLS) enabled.
Stripe — Payment processing. We do not store your payment information.
Netlify — Web hosting.
Flodesk — Email marketing for users who have opted into our interest list. Governed by Flodesk's own privacy policy.
Resend — Transactional email delivery (e.g., password resets).
OpenLibrary API — Used by the ISBN book scanner to look up book metadata. No personal data is transmitted to OpenLibrary.

We do not authorize any of these third parties to use your data for their own marketing purposes.

5. Children's Privacy (COPPA)

Morning Rhythm is designed to be used by parents and adult educators. We do not collect personal information directly from children. All accounts are held by adults. The names and educational information of children entered into the App are provided by the parent account holder and are treated as part of their account data.

We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will delete it promptly. If you believe your child's information has been collected without your consent, please contact us at hello@yourmorningrhythm.com.

6. Data Security

We take the security of your data seriously. Morning Rhythm uses:

Supabase Row-Level Security (RLS) to ensure users can only access their own data.
Encrypted passwords — we never store plaintext passwords.
HTTPS for all data in transit.
Secure cloud storage with access policies for portfolio files.

No system is completely secure. We cannot guarantee absolute security, but we take reasonable measures to protect your information.

7. Your Rights & Data Control

You are in control of your own data. Morning Rhythm is designed so you can access and keep your records without relying on us:

Export your records anytime — tap Settings → Export Annual Report to download a complete PDF of your attendance, subjects, books, and grades. No need to contact us.
Correct inaccurate data directly in the app through your account settings.
Delete your account and all associated data by emailing hello@yourmorningrhythm.com. Requests will be fulfilled within 30 days.
Request assistance — if you need help accessing your data and cannot use the in-app export, email us at hello@yourmorningrhythm.com and we will help you.
Unsubscribe from marketing emails at any time via the unsubscribe link in any email we send.

8. Data Retention

Your data is stored securely for as long as your account exists. Cancelling your subscription does not delete your account or your data — your records remain accessible and you can log back in at any time to download your Annual Report. If you choose to permanently delete your account, all associated data will be deleted within 30 days of your request. We recommend downloading your Annual Report before requesting account deletion.

9. Cookies

Morning Rhythm uses session cookies necessary for authentication and app function. We do not use tracking cookies, advertising cookies, or third-party analytics cookies that follow you across websites.

10. California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt out of the sale of personal information. We do not sell personal information. You can export your data directly from the app at any time. To request deletion or for any other privacy inquiry, contact us at hello@yourmorningrhythm.com.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or in-app notice at least 14 days before changes take effect. Continued use of the App after changes take effect constitutes acceptance.
